General facing graft raps facing pre-court martial probe

MANILA, Philippines — An Army general accused of extorting money from applicant soldiers is undergoing pre-trial investigation to determine whether or not he should be tried by court martial, Army chief Lieutenant General Alexander Yano said Wednesday.

The Judge Advocate General’s Office (JAGO), the military’s prosecution arm, is studying whether Major General Jose Barbieto can be charged for violation of Article of War 96 or conduct unbecoming an officer and a gentleman, Yano said.

Barbieto was relieved as commander of the 10th Infantry Division in Cagayan de Oro last week. He was not restricted but was “attached and assigned” to Army headquarters in Fort Bonifacio, Yano said.

“After which [pre-trial], we will determine if it warrants the conduct of court martial,” Yano told reporters in Camp Aguinaldo.

“We will give him [Barbieto] due process…He will also have to defend himself, clear his name, which we want quick and fast,” he said.

Barbieto is the highest military official, since retired Major General Carlos Garcia in 2005, to face court martial proceedings for alleged corruption.

Garcia is accused of amassing millions of pesos in unexplained wealth during his stint as military comptroller. He was convicted by a court martial in December 2006. His plunder case before the Sandiganbayan anti-graft court is pending.
