‘Issue hold-departure vs Teehankee’

MANILA, Philippines — The former lawyer of the family of murder victim Maureen Hultman is asking Malacañang to issue a hold departure order against convicted killer Claudio Teeankee Jr.

Lawyer Ernesto Francisco Jr. said the Palace’s action was necessary so as not to render “moot and academic” his petition for the Supreme Court to recommit Teehankee to the New Bilibid Prisons.

Teehankee was released earlier this month, after President Gloria Macapagal-Arroyo granted him executive clemency, sparking much controversy.

“You are requested to consider the issuance of a hold departure order against Claudio Teehankee Jr. pending final adjudication of the said petition,” Francisco said in a letter to Executive Secretary Eduardo Ermita dated October 23.

Francisco it was within the power of the Executive Department, under Department of Justice (DoJ) Circular 17, to issue a hold departure order “in the interest of national security, public safety or public health.”

The lawyer said he did not ask Justice Secretary Raul Gonzalez to issue the hold departure order because his statements showed “utmost bias” against the Hultmans.

Seeking a hold departure order from the lower courts is also not possible, since under the same DoJ circular, this is under the “exclusive jurisdiction” of the regional trial courts, and the Hultman case has been long terminated, Francisco said.
